THE BIDEN PUBLIC CHARGE REGULATION

What you need to know

On September 8, 2022, the U.S. Department of Homeland Security (DHS) issued a new "public charge" immigration regulation. This new policy strengthens important safeguards to guarantee immigrant families' access to the safety net of health and social services.

The new rule, which goes into effect on December 23, 2022:

  • Clarifies what is and is not considered in deciding a public charge

  • Confirms that eligible immigrant families can access health care, nutrition, and housing programs free of charge, and

  • Makes it more difficult for future presidents to drastically alter public charge policy.

Find out more about the public charge and whether it applies to you.
